Membership Policy
Hair Bar NYC CORPORATION (also known as HAIR BAR NYC), “membership” programs are offered by Hair Bar NYC, to our valued clients. The membership terms form the agreement between each client who participates in our membership programs, known as “member” and Hair Bar NYC. Hair Bar NYC reserves the right to change the terms or adopt additional rules, regulations, policies, or procedures (‘Related Rules”) affecting our membership and to terminate a Member’s Membership at any time for any reason without prior notice. By participating in our membership, the Member agrees to these terms and Related Rules. Each Member is responsible for remaining knowledgeable about our Membership terms and Related Rules contained herein. Members agree to pay monthly to participate in a Membership. Current memberships are monthly terms. There is an initiation fee for all memberships. Each Membership will have a one-time Initiation Fee to cover the cost of set up and recurring billing, per subscription.
HAIR BAR NYC may increase Membership pricing at some point. Active memberships will not be subject to increase until after their current subscription has been fulfilled to full term.
Frozen memberships will have 30 days after unfreezing, before they are subject to the increase. Clients will then have the option to sign up again for a new Membership at current pricing. The initiation fee will be waived at the start of a new membership in the event of a rate increase as long as the new membership is activated immediately.
Memberships can be suspended for a declined payment or failing to update billing information. Members must authorize HAIR BAR NYC to charge the missing payment within (5) days of the scheduled payment date. Members who fail to submit new credit card information will be subject to another initiation fee again to start up a new membership into active status.
AUTHORIZED TERMS OF USE:
Members authorize HAIR BAR NYC to automatically charge a designated credit or debit card each month, and a credit card is required to keep on file for all Memberships. It is the Member’s responsibility to keep HAIR BAR NYC informed of accurate billing information. The membership fees will recur each month until canceled in writing by member.
The recurrent fees will be charged automatically on the same day as the original sign-up date each month according to the corresponding plan.
Benefits cannot be combined with other discounts or vouchers and allowed only on single services listed in each membership description.
Membership benefits cannot be combined with another membership. Keratin Klub memberships require 6 months minimum.
All membership benefits may be used at any of our current locations, which can be found on our website, hairbarnyc.com.
MEMBERSHIP FREEZE TERMS:
Active members may request to freeze their monthly subscription for up to 5 months. After the designated freeze time has expired, your credit card will automatically be charged on the next billing cycle, for the original subscription amount as terms are stated.
Members may not use any benefits while the billing is frozen. There will be a $10 monthly freeze auto billing during this time, until member requests to unfreeze subscription in writing to [email protected], by phone or in person.
MEMBERSHIP CANCELLATION TERMS:
A member may cancel a membership at any time except our Keratin Membership requires a minimum of 6 months subscription. There will be “no refunds” nor “pro-rated refunds” due to cancellation once a billing has occurred and the membership will continue until full term. Cancellation of memberships requires 10 days written notice to [email protected] to avoid future billing.
REFUNDS:
No refunds are allowed. Memberships are FINAL immediately upon purchase.
RELATED TERMS:
ID is required to use a membership. HAIR BAR NYC reserves the right to request proper identification from a member before providing discounts and or benefits for each membership term as stated.
Member also agrees to allow HAIR BAR NYC to communicate with member via email, phone, (including SMS messages), external websites and various other channels about status, credit card information, promotions, changes, and any matter HAIR BAR NYC believes it may be of interest to the member.
Memberships will be terminated immediately if a member attempts a charge-back of a membership payment. In this case the credit card will no longer be billed for the next billing period and terms to cancel a membership will apply. Terminated members must receive approval from management to reinstate memberships.
Gratuities on membership services are not included -Discounts on products and tools apply to in-store only –
- Discounts and benefits have no cash value
- Discounts and benefits are non-transferable unless during a special offer sent directly to your email or posted in salon – Any attempt to transfer membership benefits may result in automatic cancellation.
- Discounts and benefits cannot be combined with other discounts, offers, or any type of voucher including any 3rd party voucher.
- Services, tools and products are subject to availability.
- “Included in membership price benefits” do not accrue on monthly memberships and cannot carry over to the next month.
- Must be 18 years of age to purchase and sign for memberships.
- Taxes and service fees are additional.
- Prices and discounts are subject to change.
- Additional Length and thickness fees may apply
INDEMNIFICATION:
Attorney’s feesYou agree to defend, indemnify, and hold us and our own partners, employees, and affiliates harmless from all liabilities, claims, and expenses, including attorney’s fees that may arise from your use or misuse of this Site, its content, or any products or services offered therein. We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will cooperate with us in asserting any available defenses. Also, in the event it becomes necessary for HAIR BAR NYC to enforce the terms and conditions of this agreement, HAIR BAR NYC shall be entitled to recover all of its costs incurred in such efforts, including but not limited to, actions or proceedings commenced and prosecuted against member.
GOVERNING LAW:
This agreement shall be construed in accordance with, and all disputes shall be governed by the internal laws of Florida and/or New York without giving effect to its conflicts of laws principles and rules. You agree and hereby submit to the exclusive personal jurisdictions and venue of the state and federal courts of the corresponding county, and state as listed above.
FORCE MAJEURE:
HAIR BAR NYC shall not be responsible for failure or delay in performance from any event beyond our reasonable control, whether or not foreseeable by either party including, but not limited to: labor disturbance, war, fire, accident adverse weather, inability to secure transportation, governmental act or regulation, and other causes or events beyond our reasonable control, whether or not similar to those which are enumerated above.
HEADINGS:
The headings in this agreement are for reference only and shall not affect the interpretation of this agreement.
WAIVER:
No waiver by any party of any of these provisions hereof shall be effective unless explicitly set forth in writing and signed by the party so waiving. No waiver by any party shall operate or be construed as a waiver in respect of any failure, breach, or default not expressly identified by such written waiver, whether of a similar or different character, and whether occurring before and after that waiver No failure to exercise, or delay in exercising, any right remedy, power, or privilege hereunder preclude any other further exercise thereof of the exercise of any other right, remedy poser or privilege.
CHEMICAL WAIVER:
I am at least eighteen (18) years of age and have received a hair analysis and or consultation with a Hair Bar NYC stylist. I have provided all the requested information regarding any previous chemical or color treatment(s) that has been performed on my hair. I acknowledge that any of these prior treatments, including color treatments, may affect the outcome of my keratin, color and or other hair services. My stylist has explained to me the best available treatment he or she recommends for my hair type, texture, and current condition, based on my desired results. I understand that a Keratin Treatment is a hair smoothing treatment which significantly reduces frizz, volume, and curl, but it’s NOT a substitute for a permanent straightening treatment. Results may vary from person to person, and I acknowledge that I have been advised of the potential outcome I can expect from this keratin treatment. Keratin Treatments, color treatments and other chemical treatments can produce fumes during the procedure, which may cause irritation for some individuals. I acknowledge that I have been offered the option of a facial mask or shield for my eyes and face should they become sensitive or irritated during the procedure. **I also acknowledge that I am currently NOT pregnant, or nursing and I have advised my stylist of any potential health concerns, allergies, or medical conditions that I’m listing below. I have read and understand the terms of this Liability Waiver Form. I confirm that by signing this form, I hereby waive and release Hair Bar NYC Inc. and its employee(s) from any and all claims for damages or any other liabilities of any kind arising from or in any way related to; keratin service(s), color service(s) or any other chemical treatment(s) being provided to me by Hair Bar NYC Inc. and or its affiliates. I also understand that Hair Bar NYC Inc., has a strict 5-day Service Satisfaction Policy. In the event you find yourself unhappy with your results, please contact the salon where you received your service(s) within 5 days of service, so that we can arrange for an analysis to determine the best course of action to rectify the situation. After the 5 days period no service satisfaction requests will be honored.
ENTIRE AGREEMENT:
This agreement, including the membership form, constitute the sole and entire agreement of the parties to this agreement with respect to the subject matter contained herein, and supersedes all prior and contemporaneous understandings. Agreements, representations, and warranties, whether written and oral, with respect to such subject matter.
